The following terms used in these General Conditions of Sale and Use (hereinafter "GCSU") shall have the following meanings:
Article 2 - Purpose
The present General Terms and Conditions of Sale govern the relationship between SOOK PARIS, SARL, Siret/ICE number: 002286362000093, whose registered office is located at Sook Paris, rue des vieux Marrakchis, 40000 Marrakech, MOROCCO and represented by Mr Jonathan Marouani (hereinafter referred to as "SOOK PARIS") and the Customer with respect to the sale of Products on the Site. Access to and use of the Site, as well as the placing of Orders, imply the Customer's unreserved acceptance of the present GCSU.
Article 3 - Modification of the GTCU
SOOK PARIS reserves the right to modify these GCU at any time. The GTCU applicable to an Order are those in force at the time the Order is placed. on the date the Order is placed.
Article 4 - Applicable law and jurisdiction
These GCU are governed by French law. In the event of a dispute, the Parties shall endeavor to reach an amicable settlement. Failing amicable settlement within two (2) months, the dispute will be referred to the competent courts of Paris.
Article 5 - Access to the Site
SOOK PARIS endeavors to maintain permanent access to the Site, but cannot guarantee uninterrupted access. Access to the Site may be suspended at any time without notice, in particular for maintenance purposes or in the event of force majeure.
Article 6 - Personal data, cookies, protection of minors and hypertext links
6.1 Processing of personal data
SOOK PARIS collects and processes the Customer's personal data in accordance with the French Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation. (RGPD). Customers have the right to access, rectify, delete and limit the processing of their personal data. Data is kept for the time necessary to process the order and to meet SOOK PARIS' legal obligations.
6.2 Cookies
The Site uses cookies to improve the user experience. These include session cookies and audience measurement cookies. Customers may prevent the use of cookies by configuring their browser, but this may affect the use of the Site.
6.3 Protection of minors
Orders placed by minors must be made by the parental authority. In the event of accidental collection of a minor's personal data, the parental authority may object to their storage.
6.4 Hypertext links
The Site may contain hypertext links to third-party sites. SOOK PARIS is not responsible for the content of these sites.
Article 7 - Site registration
7.1 How to register
To place an Order, the Customer must create an account on the Site by providing accurate and complete information.
7.2 Authentication and security
The Customer is responsible for the confidentiality of his/her login information. SOOK PARIS cannot be held responsible for any unauthorized use of the Customer's account.
Article 8 - Ordering
8.1 Contract formation
The sales contract is formed when SOOK PARIS confirms the Order.
8.2 Order placement and validation process
The Customer selects the Products, customizes them if necessary, adds them to his/her basket and validates his/her Order after checking the details and accepting the GCU.
8.3 Order cancellation
The Customer may cancel the Order free of charge prior to shipment. To cancel an Order, the Customer must contact SOOK PARIS customer service as soon as possible by email at contact@sook-paris.com
Article 9 - Prices, invoicing and payment
9.1 Prices
Prices are quoted in euros and dirhams and include all taxes. Delivery charges are extra.
9.2 Invoice
An invoice is issued by SOOK PARIS and sent to the Customer electronically.
9.3 Payment
Payment is made by credit card (Visa, Mastercard, Carte Bleue) or Paypal via the PAYZONE secure payment solution.
Article 10 - Delivery
10.1 Delivery times
Delivery times are indicated on the Site and confirmed when the Order is placed. Delivery times for personalized products may vary. An indicative delivery time of 10 working days is to be expected for personalized products, excluding the Ateliers de confection's vacation periods.
10.2 Place of delivery
Delivery is made to the address indicated by the Customer when placing the Order.
10.3 Transfer of ownership and risk
Ownership and risks are transferred upon delivery of the Products to the Customer.
Article 11 - Right of withdrawal
The Customer has a cooling-off period of fourteen (14) clear days from receipt of the goods. Products, in accordance with article L.221-18 of the French Consumer Code. The right of withdrawal does not apply to personalized Products, in accordance with article L.221-28 of the French Consumer Code. To exercise the right of withdrawal, the Customer must contact SOOK PARIS customer service. Return shipping costs are the responsibility of the Customer.
Article 12 - Returns and Warranty
12.1 Reservations on acceptance
In the event of damage or shortage upon delivery, the Customer must make reservations with the carrier and inform SOOK PARIS as soon as possible.
12.2 Non-conformity
In the event of non-conformity of the Products, the Customer may request a replacement. SOOK PARIS will bear the cost of return shipping.
12.3 Commercial guarantee of satisfaction
SOOK PARIS offers a commercial guarantee of satisfaction allowing the Customer to return a non-personalized Product and benefit from a credit valid on the Site. Return shipping costs are at the Customer's expense. The "anonymization costs" mentioned in article 7.5.3 correspond to the costs of restoring the Product to its original condition so that it can be resold (for example, removal of personalized embroidery).
Article 13 - Limitation of liability
The liability of SOOK PARIS is limited to direct damage foreseeable at the time of conclusion of the contract.

Article 15 - Intellectual property
The Site and its content are protected by intellectual property law. Any unauthorized reproduction or use is prohibited. By placing an order for a personalized Product, the Customer grants SOOK PARIS a non-exclusive and free license to use the personalization elements (text, images, etc.) provided.
Article 16 - Evidence
The computerized registers of SOOK PARIS are considered as proof of communications, Orders and payments between the Parties.
Article 17 - Customs duties
The Customer is informed that customs taxes, import duties or other similar charges may be applied by the authorities of the country of destination upon delivery of the Products.
